Though he was given a clean chit in the year 2005, he isn't completely innocent. In the same year, he was found guilty in Bonnie Lee's wrongful death lawsuit and was ordered to pay $30 million.

As roles slipped out of his hands, he closed in on being a drug dealer. In 2000, he was convicted of drug charges, and carrying a concealed and loaded illegal firearm and was sentenced to probation. When his girlfriend and mother of his son, Stephanie Spears chose to end their 12-yr-long relationship, he killed her with a dumbbell in front of his 3-yr-old son and fled with him from there. Next, when he was tracked by police in California, he locked himself up in the bathroom with his son and held his son hostage for two hours and threatened to kill the young boy during police negotiations. However, ultimately Benitez was shot and killed, but his son survived with only a bullet wound to thigh.
